Terms of Service

Note: This document is a draft prepared by the FamilyCart team. It is honest and accurate to how the app works today, but it is not a substitute for review by counsel. Independent legal review is recommended before relying on this document for any compliance regime beyond App Store submission.

These Terms of Service ("Terms") govern your use of FamilyCart, a shared grocery-list app for families and households (the "Service"). By installing or using FamilyCart, you agree to these Terms. If you do not agree, please do not install or use the app.
Acceptance of terms
By downloading, installing, opening, or using FamilyCart, you agree to be bound by these Terms and by the Privacy Policy. These Terms apply to every member of every family workspace.
Eligibility
You must be at least 13 years old to create a family or to be the primary user of a device running FamilyCart. Children under 13 may participate in a family workspace under the supervision of a parent or guardian who is themselves an eligible user, on the understanding that the parent or guardian is responsible for the child’s use of the app.
Family workspace rules
FamilyCart provides the app and the shared-list infrastructure. You are responsible for:
- The content you and your family add to your shared list (store names, items, notes, favorites).
- Sharing your family code or QR code only with people you trust enough to give shared access to your grocery list.
- Removing family members who should no longer have access (for example, a former roommate or a guest who joined temporarily). Family admins can remove members from the Family Info screen in Settings.
We don’t moderate the contents of family lists. The list belongs to your household.
Acceptable use
You agree not to:
- Use FamilyCart to share or store unlawful content, or content that violates the rights of others.
- Attempt to access another family’s data, family code, or workspace without permission.
- Reverse engineer, scrape, or interfere with the operation of the Service.
- Use the Service to harass, abuse, or impersonate another person.
We may suspend or remove any device, family, or family member that materially violates these rules.
Service availability
FamilyCart is provided on an "as-is" and "as-available" basis. We do not promise any specific uptime, performance level, or service-level agreement. We may add, change, suspend, or discontinue features at any time, with or without notice. We will try to give reasonable notice of significant changes when we can.
Intellectual property
FamilyCart owns the app, the FamilyCart name, the FamilyCart logo, and the underlying software and infrastructure. These Terms do not grant you any ownership rights in the app or the brand.
You retain ownership of the content you add to your family list. We do not claim any ownership of grocery items, store names, notes, or favorites you create. We process that content only as needed to operate the Service for you and your family.
Termination
You may stop using FamilyCart at any time by removing yourself from any families you’ve joined and deleting the app from your device. Data-deletion procedures are described in the Privacy Policy.
We may suspend or terminate your access to FamilyCart, or remove a family or device from the Service, if we reasonably believe you have violated these Terms — for example, by attempting to access another family’s data, abusing other users, or using the Service to share unlawful content. Where we can, we will give notice and an opportunity to correct the issue first.
Disclaimers and limitation of liability
FamilyCart is provided without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, and we do not guarantee the accuracy or availability of any list content.
To the fullest extent permitted by law, FamilyCart and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill arising out of or related to your use of the Service.
This is a plain-language placeholder. A fully drafted limitation-of-liability section will be substituted on counsel review.
Governing law and dispute resolution
These Terms are governed by and construed under the laws of the State of California, United States of America, without regard to its conflict-of-laws principles.
If a dispute arises out of or relates to these Terms or the Service, you agree to first attempt to resolve it informally by emailing contact@optiwise.us. If informal resolution is not possible within thirty (30) days, the dispute will be brought exclusively before the state and federal courts located in San Francisco County, California, and you and FamilyCart consent to the personal jurisdiction of those courts.
Changes to these Terms
We may update these Terms as the Service evolves or as legal requirements change. The Effective date at the top of the page will change when the document is updated. Continued use of FamilyCart after a change indicates acceptance of the updated Terms. If a change is significant, we will try to give reasonable notice in the app.
